Candidates for studies

Fulfilling the information obligation pursuant to Article 13 sec. 1 and 2 of the Regulation of the European Parliament and Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) [OJ EU L. 2016.119.1 of 4 May 2016], hereinafter referred to as the “GDPR”, we hereby inform that:

1.    The Controller of your personal data is the AGH University of Science and Technology in Cracow, al. A. Mickiewicza 30, 30-059 Cracow.

3.    Your personal data shall be processed for the purpose of admission for studies at AGH, including receipt of the information about the admission process sent via email, pursuant to the biding provisions of law – Article 6 sec. 1(c) GDPR, in particular:

a)    Act of 20 July 2018 – Law on Higher Education and Science (Journal of Laws of 2018, item 1668, as amended);
b)    Regulation of the Minister of Science and Higher Education of 27 September 2018 on degree programmes (Journal of Laws [DzU] of 2018, item 1861).
4.    Your personal data shall be also processed on the basis of your consent – Article 6 sec. 1(a) GDPR – to the extent and for the purposes as stipulated in the declaration of consent.
5.    Your personal data shall be processed solely for the time period necessary to achieve the purpose of personal data processing, i.e. the period stipulated in the provisions of applicable law and bylaws of AGH – uniform material list of files.
6.    The recipients of your personal data may be entities authorised to obtain such personal data pursuant to the provisions of law or entities offering technological support of IT systems, where your personal data are processed.
7.    You have the right of access, rectification, transfer and limitation of the processing of your personal data in cases and according to the terms and conditions stipulated in the GDPR.
8.    You have the right to submit a complaint with the President of Personal Data Protection Office if you decide that the processing of your personal data breaches the provisions of the GDPR.
9.    Your personal data shall not be subject to automatic decision-making processes, including profiling.
10.    The provision of your personal data to the extent stipulated by applicable law mentioned in sec. 3 constitutes a prerequisite for the execution of the enrolment process for the studies and does not require any separate consent. Failure to provide personal data excludes the candidate from the enrolment process.  On the other hand, the provision of personal data for the purposes mentioned in the declaration of consent is voluntary.
11.    The consent to the processing of personal data may be withdrawn in the e-Enrolment system by unchecking an appropriate box. The withdrawal of your consent shall not affect the legality of the processing, which is carried out on the basis of such consent prior to its withdrawal;

3.    Your personal data shall be processed by the Controller to achieve the educational objective during the studies as well as to obtain material assistance and information via email, also including performance of administrative, organisational, academic-didactic and social activities - pursuant to the binding provisions of laws - Article 6 sec. 1(c) GDPR, and in particular:
1)    Act of 20 July 2018 – Law on Higher Education and Science (Journal of Laws of 2018, item 1668, as amended);
2)    Regulation of the Minister of Science and Higher Education of 27 September 2018 on degree programmes (Journal of Laws [DzU] of 2018, item 1861);
3)    Regulation of the Minister of Science and Higher Education of 10 February 2017 on degrees awarded to higher education graduates, the conditions for awarding, and necessary elements of, higher education diplomas and certificates of completion of non-degree postgraduate program, and the specimen of the Diploma Supplement (Journal of Laws [DzU] item 279) in connection with the Act of 3 July 2018 Regulations introducing the Act - Law on Higher Education and Science (Journal of Laws [DzU] of 2018, item 1669);
4)    Regulation of the Minister of Science and Higher Education of 25 September 2014 on the nationwide list of students and nationwide list of PhD students (Journal  of Laws [DzU] item 1301, as amended) in connection with the Act of 3 July 2018 Regulations introducing the Act - Law on Higher Education and Science (Journal of Laws [DzU] of 2018, item 1669);
4.    If you provide your medical details, including the information on disability, your personal data shall be processed pursuant to your consent - Article 6 sec. 1(a) GDPR - to create appropriate conditions for your participation in the enrolment and educational processes.
5.    The recipients of your personal data shall be entities authorised to obtain such personal data on the basis of applicable provisions of law; the recipients of your personal data shall be also partner universities, where you want to attend classes (both national and international, e.g. as part of Erasmus+, Most, Mostech).
6.    Your image shall be stored in the IT system to prepare, customise and issue your e-student card as well as in the system intended for the purposes of the didactic process at the university.
7.    Your personal data shall be processed solely for the time period necessary to achieve the purpose of personal data processing, i.e. the period stipulated in the provisions of applicable law and bylaws of AGH – uniform material list of files.
8.    You have the right of access, rectification, transfer and limitation of the processing of your personal data in cases and according to the terms and conditions stipulated in the GDPR.
9.    You have the right to submit a complaint with the President of Personal Data Protection Office if you decide that the processing of your personal data breaches the provisions of the GDPR.
10.    Your personal data shall not be subject to automatic decision-making processes, including profiling.
11.    Your personal data shall not be sent to any third countries, but may be transferred to the partner university mentioned in point 5.
12.    The provision of your personal data to the extent stipulated by applicable law mentioned in sec. 3 constitutes a prerequisite for the execution of the educational process for the studies and does not require any separate consent, whereas the provision of your personal data for the purposes mentioned in sec. 4 is voluntary and requires your consent.
13.    The consent to process personal data for the purposes mentioned in sec. 4 may be withdrawn by sending an email to the address of an appropriate dean’s office, including a copy of the statement made in that respect and hand signature. The withdrawal of your consent shall not affect the legality of the processing, which is carried out on the basis of such consent prior to its withdrawal;
